SG STUD - TERMS AND CONDITIONS OF SERVICE
Effective Date: 1st June 2025
This document constitutes the binding agreement between SG Stud (“the Stud”) and the horse owner or authorised agent (“the Client”) for all services provided, including but not limited to agistment, foaling, breeding assistance, and general equine care (“Services”).
By submitting a booking form and/or delivering a horse to the Stud, the Client confirms they have read, understood, and agree to be bound by these Terms and Conditions.
1. Client Warranties and Obligations
1.1. Authority: The Client warrants they are the legal owner of the horse(s) or have the full authority of the legal owner to enter into this agreement.
1.2. Information: The Client warrants that all information provided to the Stud, including but not limited to identification, health history, and contact details, is true, accurate, and complete.
1.3. Veterinary Costs: The Client accepts full responsibility for all veterinary charges incurred by their horse(s) and agrees to be billed directly by the attending veterinarian.
2. Horse Health and Arrival Conditions
2.1. Vaccinations: The Client must provide veterinary certification confirming their horse(s) are fully vaccinated against Strangles and Tetanus. If proof is unavailable or vaccinations are not current, the Stud will arrange for vaccination at the Client's expense.
2.2. Parasite Control: All horses will be administered a 3 in 1 wormer upon arrival at the Stud, the cost of which will be charged to the Client's first invoice unless the Client supplies the product upon arrival.
2.3. Biosecurity: Any horse exhibiting signs of infectious disease (e.g., nasal discharge) will be swabbed at the Client’s expense to rule out contagious illness. The Stud reserves the right to refuse entry or mandate the immediate removal of any horse deemed a health risk.
2.4. Shoeing: All hind shoes must be removed prior to the horse's arrival. If shoes remain, the Stud will arrange for removal by a farrier at the Client's expense.
2.5. Equine Herpes Virus (EHV): All mares arriving for foaling services must be vaccinated for EHV, with veterinary proof required upon arrival.
3. Payment Terms
3.1. Deposits:
a. For dry mares arriving for breeding services, a deposit of $1,000 + GST is required prior to arrival.
b. For mares arriving for foaling services, the full Foaling Down Fee plus a deposit of $1,000 + GST is required prior to arrival.
3.2. Invoicing and Payment:
a. Invoices are issued monthly and are due for payment by the 15th day of the following month.
b. The Final Invoice must be paid in full before the horse(s) may depart from the Stud.
3.3. Overdue Accounts:
a. If an invoice is not paid in full by the 20th of the month, the Stud reserves the right to issue a ‘Suspension of Services’ order. Under this order, all non-essential work (including scans and inseminations) will cease until the account is paid in full. Essential health and welfare services will continue.
b. If an invoice remains unpaid by the 25th of the month, a late payment administration fee of 10% of the outstanding balance will be applied.
c. In the event of continued non-payment, the Stud reserves the right to arrange for the horse(s) to be transported to the Client's last known address, at the Client’s sole cost. The outstanding balance will be deducted from the deposit held.
d. Any costs associated with debt collection or legal action taken to recover unpaid fees will be the sole liability of the Client.
4. Departure and Transport
4.1. Mares that have foaled must be removed from the property by four (4) weeks post-foaling, unless a separate long-term grazing or handling contract is in place.
4.2. For the safe handling of unhandled foals, Client transport (truck or float) must be able to be safely loaded from the Stud’s designated loading ramp or stable-adjacent gate area.
5. Stallion Collection Services
5.1. A minimum of 48 hours' notice and a completed online form are required for all stallion collections.
5.2. All collection and shipping fees must be paid in full before semen is released.
6. Authority for Veterinary and Emergency Care
6.1. The Client acknowledges the inherent risks of equine breeding and foaling. By signing this agreement, the Client grants SG Stud full authority to act in the horse’s best interest in an emergency, including to:
a. Engage a veterinarian for an emergency call-out.
b. Authorise emergency transport of the mare and/or foal to a veterinary clinic for medical or surgical care.
c. Authorise humane euthanasia, upon the recommendation of a veterinarian, to prevent further suffering where all other options have been exhausted.
7. Risk, Liability, and Lien
7.1. Limitation of Liability: While SG Stud will take all reasonable care in the handling and supervision of the horses, all horses are handled and agisted at the Client’s sole risk. The Stud, its owners, and employees shall not be held liable for any accident, injury, illness, or death of any horse, Client, or visitor, except in cases of proven gross negligence.
7.2. Lien: The Client grants the Stud a lien over their horse(s) and any associated property (e.g., progeny, registration papers) under this agreement. This lien secures all outstanding fees owed to the Stud and allows the Stud to retain possession of the horse(s) until the Client's account is paid in full.
8. Stud Visits and Property Access
8.1. SG Stud is an active workplace. For health and safety reasons, all visits must be scheduled by appointment.
8.2. Clients and visitors must be escorted by an SG Stud employee at all times while on the property. Unauthorised or unescorted individuals will be asked to leave immediately.
9. Media and Social Media Policy
9.1. On-Site Photography: To ensure safety, biosecurity, and privacy, photography and videography by clients or visitors are strictly prohibited without the express prior consent of Stud management.
9.2. Stud-Provided Media and Promotional Use: SG Stud may take photographs or videos of the Client’s horse(s) and provide these to the Client. All such media remains the intellectual property of SG Stud. The Stud reserves the right to post celebratory ‘birth announcement’ photos on its social media following a successful foaling. For all other promotional uses beyond this initial announcement, the Stud will obtain the Client’s prior written permission before using images or videos of their horse(s).
9.3. Client Social Media Sharing:
a. Clients must not post any media taken at the Stud without prior written permission.
b. When sharing approved photos, Clients must credit and tag SG Stud’s official social media accounts.
c. Posts must not contain sensitive veterinary details or confidential information and must maintain a positive tone.
d. The privacy of other clients, staff, and horses must be respected.
9.4. Breach of Policy: Failure to comply with this policy is a material breach of these terms and may result in the immediate termination of services and a request for the removal of the unauthorised content.
10. Privacy Policy
10.1. Collection: SG Stud collects personal information including name, contact details, location, and billing information for the purpose of providing services and direct billing.
10.2. Sharing: We share this information with our staff and our primary veterinary service, Waikato Equine Veterinary Centre, for direct billing purposes.
10.3. Storage and Security: Your information is kept secure in encrypted files with restricted access. It is stored for a minimum of seven years, after which it is securely destroyed.
